Zoning and Permits in Ocean View Hills

Ocean View Hills is in the City of San Diego: what that means for zoning, the ADU rules and Bonus ADU program, the HOA layer, and how Rudy can help start the conversation.

Ocean View Hills sits inside the City of San Diego, so its zoning and permits run through San Diego’s Development Services and Planning departments, not Chula Vista’s. On top of that, a planned community has its own association rules. Here is the map, and where Rudy can help you start well.

Whose rules apply

Ocean View Hills is one of the communities in the Otay Mesa area, which the city plans through the Otay Mesa Community Plan. Land use, permits and the ADU rules come from the City of San Diego; the City Planning Department publishes housing programs and can be reached at 619-235-5200 or [email protected]. Your association’s rules then apply in addition: exterior changes, additions and sometimes ADUs may need association approval.

ADUs and the Bonus ADU program

The City of San Diego’s program lets a single-family lot have one ADU and one junior ADU, and lets multifamily lots add up to two detached ADUs or convert existing space (up to 25% of existing units for habitable space). Its Bonus ADU program offers additional ADUs in exchange for affordable ones: within Transit Priority Areas, one bonus ADU may be permitted for each affordable ADU, with the affordable units deed-restricted for 15 years to very low-, low- or moderate-income households. Ask the city whether your address is in a Transit Priority Area, and what the current fees and size limits are. The San Diego Housing Commission also offers an ADU financing program for eligible homeowners.

What has changed

  • Accessory dwelling units (ADUs). Several changes take effect in 2026. A city must decide within 15 days whether an ADU application is complete, and an application it fails to answer in time is treated as complete (SB 543). A city may require owner-occupancy for a junior ADU only when it shares a bathroom with the main home (AB 1154). And an ADU ordinance that a city does not send to the state within 60 days of adopting it, or does not answer the state’s findings on within 30 days, is null and void (the 2025 bill SB 9, not to be confused with the 2021 lot-split law of the same number).
  • Faster permits. If a jurisdiction cannot meet a 30-business-day post-entitlement review estimate, applicants can use private plan checkers (AB 253), and final inspections must be completed within 10 business days after the builder notifies the city that construction is finished (AB 1308).

The city’s regulatory updates page also reports that qualifying housing projects using the city’s Complete Communities Housing Solutions program can receive ministerial permit review within 30 days, under a Mayor’s executive order. Ask whether a project like yours qualifies.
